1. INTRODUCTION 

These provisions regulate the use that the Internet user/s (hereinafter, the “User“) may make of the domain http://acrosslegal.com/ (hereinafter, the or our “Website“) owned by ACROSS LEGAL, S.L.P. (hereinafter, ACROSS LEGAL) whose full details may be consulted here. 

These terms and conditions of use are supplemented by our Legal Notice, Privacy Policy and Cookie Policy. 

The mere access to our Website implies full acceptance of the terms and conditions of use by the User (hereinafter, the “Terms of Use“). In case of not agreeing with all or part of them, we recommend the User to refrain from using our Website. 

2. USE OF OUR WEBSITE 

2.1. Use  

The User agrees to make a correct and diligent use of our Website in accordance with the Law and these Terms of Use, assuming any liability that may arise as a result of a breach of it. 

In particular, the User may not do the following: 

1. Upload data, information or comments that are inaccurate, may be unlawful or may damage property or rights of ACROSS LEGAL or third parties. 

2. Computer attacks of any kind that overload, damage or render useless this Website, the networks, servers and other equipment of ACROSS LEGAL or third parties. 

3. In particular, and by way of example, the following: 

• Extract, introduce or disseminate any content that infringes industrial and/or intellectual property rights or business secrets of third parties, the protection of personal data of third parties. 

• Enter or disseminate information that is not truthful or that threatens or may threaten the integrity, honor or image, or that is or may be racist, homophobic, false, inaccurate, misleading or otherwise contrary to the law, morality, good customs and the requirements of good faith and established public order. 

2.2. Contents  

Our Website provides access to various information, services, images, texts, sound, visual and audiovisual recordings and databases on the Internet (hereinafter, the “Contents“), which are owned by ACROSS LEGAL or its licensors.  

The User, in accordance with current legislation, must refrain from: 

1. Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Contents except in the cases authorized by law or expressly consented to by ACROSS LEGAL or by the holder of the exploitation rights, as the case may be. 

2. Extract and/or reuse all or a substantial part of the Contents of the Website, as well as of the databases made available to Users by ACROSS LEGAL. 

3. Do not alter, copy, download, modify, decompile, disassemble, reverse engineer, reverse engineer, license, lease, sell or imitate the Website, its Contents or its underlying software.

Without prejudice to the provisions of Clause 4, as well as the privacy policies of the Website and that may be applicable from time to time, requests addressed to ACROSS LEGAL shall require the provision of certain personal data, the processing of which shall be carried out in accordance with our Privacy Policy.

In any event, the User shall be solely liable for any false or inaccurate statements made and for any damages caused to ACROSS LEGAL or third parties as a result of the information provided.

These Conditions of Use refer only to the Website and Contents of ACROSS LEGAL and shall not apply to links, third party web pages accessible through the Website or any other content provided by third parties. ACROSS LEGAL shall not exercise any control over the information, contents, products or services provided by third parties with links to the Website. 

Consequently, ACROSS LEGAL shall not assume any liability whatsoever arising therefrom, nor shall it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, validity and constitutionality of any material or information contained in any such hyperlinks or other Internet websites. Likewise, the inclusion of these external links shall not imply any kind of association, merger or participation with the linked entities. Furthermore, ACROSS LEGAL hereby declares that it shall proceed to remove or disable any link or content as soon as it becomes aware that the activity or information of third parties to which it refers may contravene the legislation in force, morality or public order, as well as infringe the rights of third parties. 

3. INTELLECTUAL AND INDUSTRIAL PROPERTY 

All intellectual and industrial property rights applicable to the Contents included in the Website are owned by ACROSS LEGAL or its licensors and are protected by national and international legislation in force. Unless otherwise expressly stated, all rights over the Contents are the exclusive property of ACROSS LEGAL. 

The foregoing includes, but is not limited to, images, trademarks, logos, distinctive signs, sounds and animations, texts, sound, visual and audiovisual recordings, and the databases that make up the Website and are part of the same. 

Any use by you not expressly authorized in advance by ACROSS LEGAL, whether direct or indirect, whether for profit or not, of the Contents, including downloading and storage, transmission, public communication, distribution, reproduction or transformation, in whole or in part, of the same, is expressly prohibited, and ACROSS LEGAL may take any legal or extrajudicial action it deems appropriate as a consequence of any infringement of its rights. 

4. DATA PROTECTION 

The personal data collected on our Website in connection with the different forms and the User’s browsing on our Website, as well as the communications or requests sent via its online forms, shall be processed by ACROSS LEGAL, as data controller, in accordance with the regulations applicable from time to time and guaranteeing the confidentiality thereof, as set forth in our Privacy Policy and our Cookies Policy. 

5. LIABILITY 

ACROSS LEGAL shall not be liable for the web pages of third parties accessible from this Website, nor for the accuracy, truthfulness and validity of the information on the Website which are not of its own creation, the contents of which belong to third party information sources outside ACROSS LEGAL. 

However, by virtue of article 17 of Law 34/2002, of July 11, 2002, on information society services and electronic commerce, when ACROSS LEGAL becomes aware of the unlawfulness of such contents or links, it undertakes to remove or disable such links, as well as to remove or, as the case may be, block those contents which may be unlawful or infringe the rights of third parties, in accordance with articles 11 and 16 of the same Law. 

Neither shall the company be liable for damages caused by failures or misconfigurations of the software installed on the User’s computer. All liability is excluded for any technical incident or failure that occurs when the User connects to the Internet. Likewise, the non-existence of interruptions or errors in accessing the Website is not guaranteed. 

Furthermore, ACROSS LEGAL reserves the right to update, modify or delete the information contained in the Website, as well as its configuration or presentation, at any time without assuming any liability for such action. 

6. MODIFICATIONS TO THE TERMS OF USE 

ACROSS LEGAL reserves the right to modify or update the Terms of Use at any time. In any case, it is advisable to consult these Terms of Use from time to time as they may be modified. 

7. APPLICABLE LAW AND JURISDICTION 

These Terms of Use are governed by and construed in accordance with the Laws of Spain. The Courts and Tribunals of the City of Barcelona shall be competent for any claim.  

8. NOTIFICATIONS AND USER SUPPORT
